By accessing or using this website (“Framofy,” “We,” “Our”) or any associated platforms, purchasing any frames or products (collectively, “Products”) on Framofy, or using any services provided by us, including services enabled via our site or application (collectively, “Services”), you represent that:
1. You have read, understood, and agree to be bound by these Terms of Use.
2. You are of legal age and competent to enter into a binding contract with Framofy as per the provisions of the Indian Contract Act, 1872.
3. You have the authority to agree personally or on behalf of any individual or entity you represent.
The term “you” refers to any individual or legal entity engaging or transacting with Framofy. If you disagree with these Terms of Use, you are not authorized to access or use our services. These Terms of Use govern any orders placed on Framofy for Products and Services (“Order”).
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and safeguard your information. By using Framofy, you consent to the actions outlined in our Privacy Policy.
USERS:
You can browse Framofy without creating an account. However, placing an order requires account registration. The information you provide during account creation and transactions must be accurate, current, and complete. Framofy reserves the right to deny or terminate access if any information is found to be inaccurate or incomplete.
ACCOUNTS:
When creating an account, you must provide your name, contact details, and a password (“Account Information”). Framofy presumes that any activity under your account is authorized by you. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Framofy is not liable for unauthorized access or misuse of your account.
ORDER PROCESSING:
Orders on Framofy are processed as follows:
1. Select the desired Product(s) and provide payment details. Payment is processed at the time of placing the Order.
2. You may upload a digital file (“Digital Copy”)
Digital Copy: Framofy will print and frame it based on your specifications. Orders may be declined if copyright or ownership cannot be verified.
If Framofy cannot fulfill your Order, you will be notified, and any payments made will be refunded after deducting applicable charges.
ACCEPTANCE OF ORDERS:
Orders are accepted once the Product is prepared and dispatched for delivery. Payment or Order confirmation does not signify acceptance. Framofy reserves the right to decline Orders and will notify you in such cases.
SHIPPING:
Framofy ships within India using reliable courier services. Standard delivery timelines are seven business days post-dispatch but may vary based on location and transit conditions. Framofy is not responsible for delays, damages, or loss during shipping.
PAYMENTS:
Payments can be made via credit cards, debit cards, or other accepted methods. By submitting payment details, you authorize Framofy to process the transaction. You must ensure authorization for all payment methods used.
PRODUCT DETAILS:
Efforts are made to display accurate colors and details of Products, but variations may occur due to screen settings. Framofy does not guarantee an exact match between Product colors and on-screen visuals.
COUPON CODES:
Framofy offers public and private coupons, which are subject to availability and terms. Framofy reserves the right to modify or discontinue coupons without prior notice.
INTELLECTUAL PROPERTY:
All trademarks, logos, and content displayed on Framofy are the property of Cosign India Pvt Ltd or its licensors. Unauthorized use of any materials is prohibited.
USER-SUBMITTED MATERIALS:
You retain ownership of materials submitted to Framofy and grant us a non-exclusive, royalty-free license to use them for order fulfillment, marketing, and demonstration purposes. Framofy will not sell personal images without prior consent.
You warrant that materials provided do not infringe any third-party rights and have obtained permissions for identifiable individuals in submitted content.
LIMITATIONS OF LIABILITY:
Framofy’s liability is limited to the value of the Order placed. Framofy is not responsible for damages to submitted materials or Products during transit. Insurance for such materials is your responsibility.
DISPUTE RESOLUTION:
These Terms are governed by Indian law. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Pune, India. The courts in Pune shall have exclusive jurisdiction in respect of any matters arising here from. You agree to submit to the jurisdiction of courts of Pune, India and agree that venue in these courts is proper in any such legal action or proceeding.
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL COSIGN INDIA PVT LTD OR ITS LICENSORS, SUPPLIERS, OR VENDORS, OR BRANDS OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS OF ANY OF THEM, BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT COSIGN INDIA PVT LTD HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SITE OR OF FAILURE TO PROVIDE PRODUCTS OR SERVICES THAT YOU ORDER FROM FRAMOFY OR ITS AFFILIATES, INCLUDING WITHOUT LIMITATION, DAMAGES ARISING FROM MISTAKE, OMISSION, VIRUS, DELAY, OR INTERRUPTION OF SERVICE. IN NO EVENT SHALL COSIGN INDIA PVT LTD BE LIABLE OR RESPONSIBLE FOR ANY DAMAGES OR CONSEQUENCES ARISING FROM OR RELATED TO YOUR INAPPROPRIATE OR UNAUTHORISED USE OF THIS SITE OR ITS CONTENT OR OUR SUPPLIED PRODUCTS OR SERVICES.
